Reason For Data Collection
To help you book the flights, hotels and tours with information such as your name, preferred contact details, the names of anybody traveling with you, and your payment information. This information is used to contact you about your reservation or address any issue that may arise.
SATS is the sole owner of the information collected on this website and we will not sell or provide this information to any outside parties, except as outlined in this privacy statement.
Type of Data Collected
To process your reservations, we may collect name, phone numbers, billing address, IP address, e-mail, birth date, passport number, personal ID numbers and payment information such as credit card numbers or bank account numbers.
Information collected may include the time stamps of when you accessed our services, the hardware, software or internet browser you use, and information about your operating system. We also collect information about clicks and which pages have been shown to you and duration.
We may collect personal data you give us directly as you access our services. We may also receive personal data from third parties, for example, if you interact with us through social media platform such as Facebook, Twitter or Instagram.
Our services are for people above 18 years old. We only process information about children/kids with the consent of the parents or legal guardians or when the information is provided to use by the parents or legal guardian.
Sharing of your Personal Data
We may divulge your personal data to our relevant partners only when it is necessary for the purposes of serving you, and on the legal basis set out in this notice.
We may divulge your personal data to our insurers and/or professional advisers in so far as reasonably necessary for the purposes of obtaining or maintaining insurance coverage, managing risks, obtaining professional advice and/or the establishment, exercise or defense of legal claims, whether in court proceedings or in an administrative or out-of-court procedure.
Financial transactions based on online services are handled by our payment service providers. We will share transaction data with our payment service providers only to the extent necessary for the processing your payments, any refund of such payments and dealing with complaints and queries.

Data Storage Duration
Your personal data will be retained for no longer than is necessary subject to this privacy statement to enable you to use our services, to provide our services to you, to comply with applicable laws, resolve disputes with any parties and otherwise as necessary to allow us to conduct our business, including to detect and prevent fraud or other illegal activities.
Great measures have been taken to protect your personal data. When you submit sensitive information via the website, your information is protected both online and off-line. All of information collected are encrypted and protected with the best encryption software in the industry - SSL.
Offline personal data are stored in secure operating environments that are not accessible to the general public, and to have security measures in place at our physical facilities to protect against the loss, misuse or alteration of your personal data by our employees or third parties.
Our Employee receive data security training more often as well as our IT Department conducts security test and maintenance on site on day to day basis.

Regarding your personal data, you have the following rights:
A.Your principal rights under data protection law are the right:

iv. to restrict processing;

vi. to data portability;
vii. to complain to a supervisory authority; and
viii. to withdraw consent.
B.The right to confirmation as to whether or not we process your personal data and, where we do, access to the personal data,
together with certain additional information. That additional information includes details of the purposes of the processing, the
categories of personal data concerned and the recipients of the personal data.
C.The right to have any inaccurate personal data about you rectified and, taking into account the purposes of the processing, to have
any incomplete personal data about you completed.
D.The right to the erasure of your personal data without undue delay under circumstances. Those circumstances include: the personal

processing, but you require personal data for the establishment, exercise or defense of legal claims; and you have objected to

your personal data. However, we will only otherwise process it: with your consent; for the establishment, exercise or defense of legal
claims; for the protection of the rights of another natural or legal person; or for reasons of important public interest.
F.The right to object to our processing of your personal data on grounds relating to your particular situation, but only to the extent that
the legal basis for the processing is that the processing is necessary for: the performance of a task carried out in the public interest
or in the exercise of any official authority vested in us; or the purposes of the legitimate interests pursued by us or by a third party. If
you make such an objection, we will cease to process the personal information unless we can demonstrate compelling legitimate
grounds for the processing which override your interests, rights and freedoms, or the processing is for the establishment, exercise or
defense of legal claims.
G.The right to object to our processing of your personal data for direct marketing purposes including profiling for direct marketing
purposes. If you make such an objection, we will cease to process your personal data for this purpose.
H.To the extent that the legal basis for our processing of your personal data is:
a consent or
that the processing is necessary for the performance of a contract to which you are party or in order to take steps at your request prior to entering into a contract, and such processing is carried out by automated means, you have the right to receive your personal data from us in a structured, commonly used and machine-readable format. However, this right does not apply where it would adversely affect the rights and freedoms of others.
I.To the extent that the legal basis for our processing of your personal information is consent, you have the right to withdraw that
consent at any time. Withdrawal will not affect the lawfulness of the processing before the withdrawing.

Terms and Condition
Reservations are required to be made in writing and with as much notice as possible.
Group /FIT’s:A non refundable deposit of 30% of the tour price is required on confirmation, if made more than 30 days before the departure of the tour. If the reservation is made within 30 days of the departure date of the tour, full payment for the tour is required. Balance of payment is required 8 weeks prior to departure or on the date stipulated on the invoice.
Cancellations must be made in writing and will become effective on the date of receipt at the offices of Silver Africa .Cancellation & Amendments by passenger/s: Charges are based on the full price of the tour and apply as follows: Silver Africa reserves the right to claim a cancellation fee of up to 100% of the total package price.

Less than 15 days before departure 100%
Less than 35 days before departure 40%

Silver Africa shall not be liable for damages of whatsoever nature, arising from any alterations or cancellations. Silver Africa shall at all times exercise its absolute discretion in regard to cancellation / refunds, including where passengers do not remain with the pre-booked holiday throughout its duration.
Silver Africa uses many suppliers, each with their own amendment / cancellation charges. Cancellations and amendments are therefore subject to our supplier’s conditions and on the understanding that the passengers shall be liable for all additional costs arising from cancellations and amendments.
Cancellation by Silver Africa : Passengers should at all times be covered by cancellation insurance, in the case of force majeure. Force majeure includes war, threat of war, riot, civil disobedience or strife, industrial dispute, terrorist activity, acts of God, natural or nuclear disaster, fire, adverse weather conditions, level of water, technical or maintenance problems with transport providers, closure of airports or any unforeseeable or unavoidable event beyond our control.
Airlines Cancellation & Refunds:
Cancellation of confirmed seats as ticketed, 25 – 100% will be forfeited according to the rules of the applicable fare. Change of reservation constitutes a cancellation.
Prices are based on current rates of exchange and are subject to variation if there are increases due to Government action, Value Added Tax, changes in exchange rates, increases in transportation costs or fuel prices, airfares or hotel rates. All prices are quoted in United States of America Dollars, unless otherwise stated. Payment is accepted at the rate of exchange at the time of receipt of payment. Bank charges are for the account of the remitter.
No adjustments to the tour price will be made or considered once full prepayment for the tour has been received by The Company.
No claim for any refund of any description shall be considered by Silver Africa , nor will any liability attach to Silver Africa , if for any reason, specific tour arrangements, accommodation, excursions or meals are unavailable or denied to passengers during the tour. Silver Africa shall, however, endeavor at all times to comply with our pre-determined tour itinerary, but cannot be held responsible for any reason should this not be possible, it being noted that it may be in the interest or for the welfare of passengers that alterations are made for their safety and any additional and / or unavoidable expenses shall become their financial responsibility.
Refunds and Unused Services
No refunds will be made for no shows, or any unused services.
It is the responsibility of the passenger(s) to effect full and comprehensive insurance cover for personal baggage / effects, foreign and local currency, travelers cheques, medical expenses, personal accident and cancellation / curtailment. Silver Africa recommends that passenger(s) take out sufficient travel insurance, in particular medical and cancellation. If this is not available in the passenger(s) country of origin, it can be purchased from Silver Africa before arrival in Kenya.
6.Luggage and Personal Effects
These are conveyed entirely at owner’s risk. Passengers should note that they are limited to one standard suitcase not weighing more than 20 kg, plus one small piece of hand luggage. When traveling on certain charter flights, baggage is limited to one soft bag weighing not more than 12 kg.
When porterage is included in the cost, one piece of luggage per person is allowed. Silver Africa accepts no responsibility for loss or damage to luggage or personal property from whatsoever cause arising. Passengers are advised to effect adequate insurance.
7.Visas, Health Requirements, Passports & Travel Documents
It is the passengers’ responsibility to ensure they possess the correct vaccination certificates, drivers licenses and insurance policies.
The countries of Eastern Africa have specific entry regulations and requirements and many recommend health precautions. It is the responsibility of all passengers / agents to ensure that their above-mentioned travel documents are in order and fully valid. Passports need to be valid for 6 months after departure from Kenya.
Passengers are recommended to approach their local consulate office(s) for general advice on travel documents. Certain nationalities require visas for certain countries in Eastern Africa.
Silver Africa recommends passengers / agents consult (before departure) their doctor or travel clinic for advice regarding inoculations and health precautions. Passengers are advised to drink bottled water and check the seal. Malaria is a risk in certain parts of Eastern Africa and it is recommended that passengers protect themselves and take malaria prophylaxis.
:Silver Africa will undertake to supply the specific accommodation requested, subject to availability. Silver Africa reserves the right to make use of alternative, similar accommodation if necessary. Passengers should note this that single accommodation always represents an additional cost, and single rooms are available on a first-come-first-served basis.
9.Shared Accommodation: Applicable to group tours:
Silver Africa undertakes at all times to arrange for shared accommodation according to passengers wishes, but shall without any liability to them, exercise sole discretion to arrange their accommodation in the best interests of the tour.
10.General Responsibility and Indemnities:
Silver Africa acts at all times in the capacity of agent for its passengers in all respects, and as such shall not be responsible in any way for damage, delay or loss of any kind whatsoever, it being noted that the tour is arranged subject to the conditions laid down by the principals for which SATS acts. Silver Africa undertakes to provide all services offered subject to the terms and conditions set out herein.
Silver Africa and its employees shall not be responsible for, and shall at all times be exempt from, any liability for accident, delay, injury or loss to any passenger including negligence by Silver Africa or its employees, whether arising from accidents, breakdowns or any other cause.
The itinerary shall at all times be subject to alteration, amendment or cancellation without prior notice or warning for any cause and particularly, but without prejudice to the generality of the aforementioned.
It shall furthermore be noted that in the event of such alterations, amendments or cancellation, whether or not imposed by the principals, no liability of any kind shall attach to Silver Africa for such alterations, amendments or cancellations.
Silver Africa shall at all times and in its sole discretion and without in any way incurring liability, cancel, amend or terminate passenger(s) tour reservation(s), without being obliged to furnish any reason therefore, particularly in the event of illness, lack of general compatibility to the group, and such passenger(s) shall under such circumstances forfeit all right of refund of the tour price.
Silver Africa operates tours as per itinerary, weather and other conditions allowing. Silver Africa does not accept responsibility for acts of omission of a third party supplying services. Silver Africa is not responsible for any damages sustained by any passenger as a result of any act of omission whatsoever by any hotel, airline or other person. Silver Africa acts at all times as an agent of such service providers.
Passengers need to be aware that Safaris frequently visit areas with wild animals. Neither Silver Africa nor its employees, nor our agents can be held responsible in any way whatsoever for any injury or incident while on safari.
12.Payment & Confirmation:
Written confirmations will be sent to passengers. Original documentation will be handed to passengers on arrival. Final payment is due 8 weeks prior to arrival or on the date stipulated on the invoice. Bookings made within 30 days prior to departure must be accompanied by full payment.
Special requests for meals, rooms etc, must be made at least one month in advance and in writing. Whilst every effort will be made to ensure that these requests are fulfilled, they cannot be guaranteed.
Air, rail, road and other departure times are supplied by the Carriers. They are at all times subject to traffic control restrictions and weather conditions. Silver Africa is not responsible for any delays or inconvenience which may arise. Transportation is in air-conditioned coaches or minibuses or as requested.
Silver Africa is a member of, and in good standing with KATO (Kenya Association of Tour Operators), ESOK (Eco- Tourism Society of Kenya), ASTA (American Society of Travel Agents) and KTF (Kenya Tourism Federation).
Silver Africa uses only registered guides and specialist guides. Silver Africa endeavours at all times to employ specific language guides as requested and when available.
17.The Contract between the Parties:
The laws of the Republic of Kenya shall govern the relationship between Silver Africa and the Operator / Travel Agent / passenger and the Courts of Nairobi of the Republic of Kenya , shall have sole jurisdiction, in respect of any claims and / or disputes of whatsoever nature, which may arise between Silver Africa and the Agent and / or passenger. Contracts between the parties, as well as any subsequent variations thereto, shall be in writing.
